1. General Terms of Use

The Landes Community Foundation ("Foundation," "we," "our," or "us") maintains this website (landescommunityfoundation.org) to provide information about our grant programs, scholarship opportunities, community impact initiatives, and donor services. By accessing or using this website, you ("user," "you," or "your") agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should discontinue use of this website immediately.

The Foundation reserves the right to modify these terms at any time without prior notice. Your continued use of the website following any changes constitutes acceptance of those modifications. We recommend reviewing these terms periodically to remain informed of updates.

2. Grant Application Terms

Submission of a grant application through our website or other channels does not guarantee funding. All applications are subject to a competitive review process conducted by the Foundation's Grants Committee and approved by the Board of Trustees. The Foundation reserves sole discretion in determining which applications receive funding, the amount of awards, and the terms and conditions attached to each grant.

Applicants are responsible for ensuring the accuracy and completeness of all information provided in grant applications. Intentional misrepresentation of organizational status, financial information, project scope, or community impact may result in disqualification from current and future funding consideration, and may require repayment of any funds already disbursed.

Grant awards are subject to a written grant agreement that specifies reporting requirements, allowable expenditures, disbursement schedules, and conditions under which funds must be returned. The Foundation reserves the right to conduct site visits, request financial documentation, and audit grant expenditures at any time during the grant period and for a period of three years following the completion of the funded project.

3. Scholarship Terms

Scholarship awards are contingent upon the recipient's continued enrollment at an accredited institution, maintenance of the required minimum GPA, and compliance with all terms specified in the scholarship award letter. The Foundation disburses scholarship funds directly to the recipient's educational institution, not to the individual student. Scholarship recipients must notify the Foundation within 30 days of any change in enrollment status, institution, or academic standing that may affect eligibility.

Renewable scholarships require annual renewal applications submitted by the deadline specified in the award letter. Renewal is not automatic and is subject to the same competitive review process as initial applications. The Foundation is not obligated to renew any scholarship award regardless of prior receipt.

4. Donor Services & Charitable Contributions

The Landes Community Foundation is a 501(c)(3) public charity (EIN: 23-3017584) registered with the IRS and the Pennsylvania Bureau of Charitable Organizations (#47291-NPO). Contributions to the Foundation are tax-deductible to the extent permitted by applicable federal and state law. The Foundation provides written acknowledgment of all gifts of $250 or more as required by IRS regulations.

Donors establishing named funds, donor-advised funds, or designated funds are subject to the Foundation's Fund Agreement, which governs the use, investment, and distribution of contributed assets. While the Foundation makes reasonable efforts to honor donor recommendations and fund designations, the Board of Trustees retains variance power as required by IRS regulations governing community foundations, meaning the Board may redirect funds if the original purpose becomes impracticable or unnecessary.

5. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of the Landes Community Foundation or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from this website without prior written permission from the Foundation, except for personal, non-commercial use such as printing pages for reference in preparing a grant application.

6. Limitation of Liability

The Foundation provides this website and its contents on an "as is" and "as available" basis without warranties of any kind, either express or implied. The Foundation does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. In no event shall the Foundation, its trustees, officers, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use this website or any services offered through it.
